"you") and Himavat Destination and Hotels Pvt. Ltd. ("Himavat Destination,"
"Company," "we," or "us"). By booking any tour or service with us, you agree to be
bound by these Terms. Please read them carefully. Proceeding with payment constitutes
acceptance of these Terms. Clients are encouraged to review the Terms thoroughly before
booking

various travel packages including group tours, customized trips, and adventure travel

Scope of Services
We offer the following services:
- Group Travel: Organized tours to domestic and international destinations.
- Customized Trips: Tailor-made itineraries to match individual or group preferences.
- Adventure Travel: Activities like trekking, backpacking, and biking trips.
Booking and Payment Terms
1. Booking Confirmation:
- A deposit is required to confirm your booking. Final quotes are subject to availability at
the time of payment.
- Any changes to your booking (e.g., hotels, airlines, itinerary) will be communicated
within 72 hours of occurrence (excluding weekends and public holidays).
- Availability may change until payment is confirmed.
2. Payment Policy:
- Payments must be made according to the terms provided at the time of booking.
- Accepted payment methods include bank transfers, and online payment gateways.
Payments are processed in INR, with applicable exchange rates on the date of payment. If
the payment is made through a credit card, an additional 3% surcharge will be applied.
- Failure to Pay: Failure to pay the full amount by the specified due date may result in the
cancellation of your booking or services, at our sole discretion.
3. Forfeiture Clause:
- • Cash deposits made to our bank accounts without prior written intimation will be
forfeited. Clients must notify us of deposits via email or phone at the contact information
mentioned.
Pricing and Inclusions
1. Pricing Policy:
- Pricing depends on availability and prevailing exchange rates. Final prices will be
confirmed at the time of booking.
- Fluctuations in exchange rates may affect final costs, even after initial booking.
2. Inclusions and Exclusions:
- Package inclusions are mentioned in your booking confirmation. Services not explicitly
mentioned are excluded and must be paid for separately.

Cancellations and Refunds
1. Cancellation by Client:
- All cancellations must be submitted in writing to hola@himavatdestination.com
- Cancellation charges apply as per the policy provided at the time of booking (refer to
Annexure A).
- Refunds, if applicable, will be processed within 7-10 working days after the cancellation
request is acknowledged by our team.
2. Credit Notes:
- Credit notes may be issued in lieu of refunds based on the nature of cancellation. These
are non-transferable unless specified and must be used within the stipulated time frame.
3. Non-Refundable Charges:
- Cancellation charges are non-negotiable and certain charges, such as insurance fees and
visa rejections, are non-refundable.
4. No-Show Policy:
- No refunds are provided for No-Show cases. Refunds are processed only as per the
amount received from airlines or other service providers, minus service fees. For
uncontrollable delays, clients must notify us immediately of potential adjustments.
Itinerary Changes
1. Modification by Company:
- We reserve the right to modify itineraries, accommodations, or transport arrangements
due to unforeseen circumstances like weather or political unrest.
2. On-Tour Changes:
- Changes during the trip due to natural calamities or other factors may occur. We will
strive to minimize disruptions.
3. Group Tours:
- A minimum of 6 paying participants is required for group tours. In case of shortfall,
alternate dates or refunds will be provided.
Travel Insurance
1. Insurance:
- Comprehensive travel insurance covering cancellations, medical emergencies, and loss of
baggage is recommended.
2. Medical Conditions:
- Clients must disclose any medical conditions that could impact their participation in the
tour.
Health and Safety
1. Health Requirements:
- Clients are responsible for meeting health and vaccination requirements for their
destinations.
2. Adventure Activities:
- Participation in adventure activities is at the client’s own risk. We are not liable for injuries
or losses arising from such activities.
Passports, Visas, and Travel Documents
1. Client Responsibility:
- Clients must ensure they have valid passports and visas, with at least six months’ validity
from the return date.
2. Visa Assistance:
- We assist with visa applications, but approval remains at the discretion of the respective
consulates.
3. Non – Indian Update
- Foreigners are not allowed to visit Baba Mandir, Nathula Pass and Gurudongmar Lake as per
local authorities. However, foreign nationals are allowed to visit Tsomgo lake, Yumthang
Valley and Zero Point mandatorily with an Indian Guide.
4. Permits / Documentation

Documentation Requirements for Permits
- To process permits for your trip, the following original documents and copies must be provided:
- For Adults: Driving License and Voter ID Card OR Passport (front and back xerox).
- For Children: Birth Certificate OR School Certificate (written in English).

Additional Requirements
- Passport-sized Photographs: Four recent photographs for each member (soft copy required).

ID Proof Copies
- Front and back xerox of one valid ID proof for each member.

Important Notes
- AADHAR CARD and PAN CARD are not accepted for permit purposes.
- Failure to provide the required documents may lead to delays or cancellation of permits.

Responsibility
- It is the client’s responsibility to ensure all documents are complete and submitted on time.
Accommodation Guidelines

Check-In / Check-Out:
- Standard check-in time is 12:00 PM, and check-out time is 10:00 AM. Early check-ins or late
check-outs may incur additional charges as per hotel policies, subject to availability.

Room Allocation:
- Room sizes and amenities may vary depending on the destination and the selected hotel category.
Air-conditioned rooms may not be available in certain regions (e.g., Europe or domestic hill
stations in India) due to climatic conditions and local standards.
- Clients are responsible for any damage caused to the property during their stay.

Service Expectations:
- In certain locations such as Lachen, Lachung, and other remote/offbeat areas, services and room
standards may be basic. Guests are advised to expect only essential amenities and to plan
accordingly.

Child Booking Policy:
- Children without Extra Bed: Ages 5–12 can stay without an extra bed (sharing existing
bedding); additional charges apply as per hotel policy.
- Children with Extra Bed: Ages 5–12 requiring an extra bed will incur charges as per the
hotel’s policy.

Additional Hotel Charges:
- Charges for mini-bar usage, heater, and any additional room services (where applicable) are not
included in the package and must be settled directly with the hotel at check-out.

Hotel Changes:
- Himavat Destination reserves the right to change hotels due to unforeseen circumstances. Clients
will be informed as soon as possible. Any upgrades or pricing implications will be discussed with
the client.
Transfers and Sightseeing
1. Transfers:

Transfers are as per itinerary and are not on a disposable basis. Adherence to the scheduled
timings is required.
2. Sightseeing:
-
Sightseeing activities may change or be canceled due to local conditions. No refunds or
compensation will be provided for unused services.
Limitation of Liability
1. Third-Party Services:

We act as intermediaries between clients and service providers (e.g., hotels, airlines). We
are not liable for the loss or damage caused by these providers.
2. Force Majeure:

We are not liable for events beyond our control, including natural disasters, pandemics, or
political unrest.
3. Liability for Personal Belongings:

Himavat Destination is not responsible for the loss of personal belongings, including
passports, Aadhar cards, PAN cards, driving licenses, etc., during the tour. Clients are
advised to safeguard valuables and travel documents, such as using hotel safes.
Conduct and Behavior
1. Code of Conduct:

Respectful behavior towards fellow travelers and adherence to local customs is expected.
Misconduct, such as harassment, excessive intoxication, or disruptive actions, may result in
tour termination without refund.
2. Responsibility for Damages:

Clients will be held responsible for any damage or losses caused by their actions during the
tour.
Governing Law and Jurisdiction
1. Governing Law:

These Terms are governed by Indian laws, with jurisdiction in Siliguri, West Bengal for any
disputes.
2. Dispute Resolution:

Any disputes arising out of these Terms shall be resolved through mediation or arbitration
as per Indian law. A timeline for resolution will be agreed upon.
3. Complaints Procedure:

If you have any complaints, please contact us immediately. We will attempt to resolve your
complaint as quickly as possible.
Amendments to Terms
We reserve the right to amend these Terms at any time. Updates will be posted on our
website
Annexure A: Payment and Cancellation Policies
Payment Schedule
Advance Payment:

30% of the total package amount must be paid in advance to confirm the booking.

Bookings will not be processed without the advance payment.
Balance Payment:

The remaining balance must be cleared at the time of arrival on the first day of the tour.

Payment can be made in cash or via demand draft drawn in favor of Himavat Destination
and Hotels Pvt. Ltd.

Cheques will not be accepted under any circumstances.

If the payment is made through a credit card, an additional 3% surcharge will be applied.
Important Note:

Failure to make payments as per the above schedule may result in cancellation of your
booking.

For Issuance of the Flight Tickets, we require Full Payment of Airfare

Non-Refundable Services in the tour package must be paid in full at the time of Booking

Payment Policy is non-negotiable and have to be paid accordingly.

Payment Schedule may vary based on the destination and travel date (such as during any
event, peak season etc.) Kindly confirm the exact payment timeline with your sales agent.

Important Note:
- Actual Airfare Cancellation will be applicable in case of Cancellation
- No Refund will be made against Non-Refundable Services in the Tour Package
- The Cancellation Policy is non-negotiable, and 5% GST will be applicable on Total Cancellation
Amount.
- The refund will be processed only after getting cancellation request/claim from the Hotel/Travel
agent/Transport Vendor company.
- The cancellation fee may vary based on the destination and travel date (such as during any
event, peak season etc.) Kindly confirm the exact cancellation timeline with your sales agent.
- Cancellations Due to Government Orders: If cancellations are made due to directives from the
State or Central Government (e.g., COVID-19 restrictions), a 100% refund will be provided.
